My comment:
What Kirchner doesn’t say is that the UN also has parameters for the solution to the dispute.
The call from the UN for negotiations says:
"The United Nations General Assembly has adopted Resolutions 2065 (XX), 3160 (XXVIII), 31/49, 37/9, 38/12, 39/6 and 40/21, 41/40, 42/19 and 43/25 etc., which recognise the existence of a dispute of sovereignty related to the question of the Falkland Islands and ask the Argentine Republic and the United Kingdom of Great Britain and Northern Ireland to initiate negotiations with a view to find the means to resolve peacefully and definitively all the aspects related to the future of the Falkland Islands in accordance with the United Nations Charter."
It does not say HAND THE ISLANDS TO ARGENTINA AND JUST TALK ABOUT THE TIMETABLE This is what we all know Kirchner means by ‘negotiations’<br>
The UN has strict parameters for the protection and free choice of Colonial Peoples. It says:
Chapter XI 'Declaration Regarding Non-Self-Governing Territories' i.e. "territories whose peoples have not yet attained a full measure of self-government"; Article 73 introduced the principle that:
"Members of the United Nations which have or assume responsibilities for the administration of territories whose peoples have not yet attained a full measure of self-government recognise the principle that the interests of the inhabitants of these territories are paramount, and accept as a sacred trust the obligation to promote to the utmost, within the system of international peace and security established by the present Charter, the well-being of the inhabitants of these territories.."
UN Resolution 1514 (XV) of 1960 says:-
'Declaration on the Granting of Independence to Colonial Countries and Peoples':
"Immediate steps shall be taken, in Trust and Non-Self-Governing Territories or all other territories which have not yet attained independence, to transfer all powers to the peoples of those territories, without any conditions or reservations, in accordance with their freely expressed will and desire."
Therefore Kirchner and Argentina are in continuing breach of UN Resolution 1514 (XV) whilst Great Britain is in full compliance.
The Kirchner administration is not only in breach but actively works to damage the economy of the Falklands by his petty action in refusing to recognize the Falkland Islands Government and the peoples legitimate right to choose their own future under UN Charter and resolutions:
UN Resolution 1541 (XV) of 1960 also says;
Principle VI:
A Non-Self-Governing Territory can be said to have reached a full measure of self-government by:
(a) Emergence as a sovereign independent State;
(b) Free association with an independent State; or
(c) Integration with an independent State."
If Kirchner and Argentina would agree to meet and negotiate on the foregoing basis as outlined by the UN and Great Britain refused he could then possibly be taken seriously in his protestations of willingness to end the dispute.
Right now it is difficult to seriously take his statements in any other way than a pandering to his own electorate and a poor effort to propagandise the situation in an attempt to mislead the world at large concerning the reality of the situation.
